Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the websites, dashboard, APIs, documentation, and related services made available by Scalith, LLC under the AbuseZero brand (collectively, the “Service”). By creating an account, accessing the Service, or using any part of the Service, you agree to these Terms.
Effective date: October 8, 2026
AbuseZero is operated by Scalith, LLC, 30 N Gould St Ste N, Sheridan, WY 82801, United States. Questions: support@abusezero.com.
1. Agreement and defined terms
These Terms form a binding legal agreement between you and Scalith, LLC (“Scalith, LLC,” “we,” “us,” or “our”). If you accept these Terms on behalf of an organization, you represent that you have authority to bind that organization, and “you” means that organization and its authorized users.
“Customer Data” means information submitted to the Service by or on behalf of you or your end users, including evaluation requests, configuration, credentials, and account information. “Documentation” means our published guides and reference materials for the Service. “Order” means an online checkout, order form, or other written agreement specifying a subscription plan, usage, or fees.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of registration information, for maintaining the confidentiality of credentials, and for all activity under your account. Notify us promptly at support@abusezero.com if you believe your account has been compromised.
3. The Service
AbuseZero is an abuse-prevention API for software-as-a-service businesses. The Service evaluates benefit claims against rules you configure and returns allow-or-deny outcomes based on the identifiers and history you supply. The Service is not identity verification, payment-fraud prevention, a guarantee of detection, or a substitute for your own authentication, billing, or delivery systems. Features, environments (including Test and Live), and limits are described in the Documentation and your Order.
4. Customer responsibilities
You agree to:
- use the Service only in compliance with applicable law and these Terms;
- obtain all rights, notices, and consents required to collect, submit, and process Customer Data through the Service;
- configure rules and interpret outcomes appropriately for your product and jurisdiction;
- not submit prohibited data types described in the Documentation (including raw payment card numbers, raw phone numbers, or postal addresses where prohibited); and
- keep API credentials and dashboard access restricted to authorized personnel.
5. Customer Data and privacy
You retain ownership of Customer Data. You grant Scalith, LLC a worldwide, non-exclusive license to host, copy, transmit, display, and otherwise use Customer Data as necessary to provide, secure, maintain, and improve the Service, to comply with law, and as described in our Privacy Policy and Data Handling Addendum. Where you process personal data of end users through the Service, the Data Handling Addendum applies and is incorporated into these Terms by reference.
6. Acceptable use
You will not, and will not permit others to:
- reverse engineer, decompile, or attempt to derive source code from the Service except to the extent prohibited restrictions are unenforceable under law;
- probe, scan, or test vulnerabilities without our prior written consent;
- interfere with or disrupt the Service or related systems;
- access the Service to build a competing product using non-public elements of the Service;
- resell or sublicense the Service except as expressly permitted in an Order;
- use the Service for unlawful, harmful, fraudulent, or abusive purposes; or
- exceed documented rate limits or circumvent usage restrictions.
7. Fees, taxes, and payment
Paid plans, usage allowances, overages, billing intervals, and renewal terms are presented at purchase or in an Order. You authorize us and our payment processors to charge applicable fees and taxes. Except where required by law or expressly stated at purchase, fees are non-refundable. Failure to pay may result in suspension or termination of the Service.
8. Confidentiality
Each party may receive non-public information from the other. The receiving party will use the disclosing party’s confidential information only to exercise rights and perform obligations under these Terms and will protect it using reasonable care. Confidentiality obligations do not apply to information that is publicly available without breach, independently developed, or rightfully received from a third party without duty of confidence.
9. Intellectual property
Scalith, LLC and its licensors own the Service, Documentation, software, designs, trademarks, and all related intellectual property. These Terms grant you a limited, non-exclusive, non-transferable, revocable right to use the Service during an active subscription or trial in accordance with these Terms and the Documentation. No rights are granted except as expressly stated.
10. Third-party services
The Service may integrate with or depend on third-party services (including hosting, email, identity, and data providers). Third-party services are subject to their own terms. We are not responsible for third-party services outside our reasonable control.
11. Disclaimers
THE SERVICE AND DOCUMENTATION ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCALITH, LLC AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTCOMES WILL DETECT OR PREVENT ALL ABUSE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, COVER, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY. EXCEPT FOR YOUR PAYMENT OBLIGATIONS, YOUR BREACH OF SECTION 6 (ACCEPTABLE USE) OR SECTION 8 (CONFIDENTIALITY), OR A PARTY’S INDEMNIFICATION OBLIGATIONS, EACH PARTY’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO SCALITH, LLC FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY. THE FOREGOING LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY.
13. Indemnification
You will defend, indemnify, and hold harmless Scalith, LLC and its officers, directors, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from Customer Data, your use of the Service in violation of these Terms or applicable law, or your product’s collection or use of end-user information. We will promptly notify you of any claim and cooperate at your expense.
14. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access immediately if you materially breach these Terms, fail to pay fees, pose a security risk, or if we must do so to comply with law. Upon termination, your right to use the Service ends. Sections that by their nature should survive will survive, including payment obligations, confidentiality, disclaimers, limitations of liability, indemnification, and governing law.
15. Changes
We may modify the Service and these Terms. We will post updated Terms with a revised effective date. If a change materially reduces your rights, we will provide reasonable advance notice through the Service or email. Continued use after the effective date constitutes acceptance of the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. The parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Sheridan County, Wyoming, for disputes not subject to arbitration. EACH PARTY WAIVES ANY RIGHT TO A JURY TRIAL TO THE EXTENT PERMITTED BY LAW.
Before filing suit, the parties will attempt to resolve disputes informally by contacting support@abusezero.com and allowing thirty (30) days for negotiation.
17. General
These Terms, together with any Order, the Customer Agreement where applicable, the Privacy Policy, Data Handling Addendum, and Cookie Policy, constitute the entire agreement regarding the Service and supersede prior discussions. If any provision is unenforceable, the remainder remains in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Notices to you may be provided through the Service or account email.
18. Contact
Legal notices and questions about these Terms may be sent to support@abusezero.com or through the Contact page.
